Terms of Service

These Terms of Service ("Terms") govern your use of socialcreators.co and your relationship with SocialCreators ("we," "us," "our") as a brand, creator, or other collaborator. By submitting a form, engaging in a campaign, or accepting a booking through SocialCreators, you agree to these Terms.

Independent Contractor Classification

All creators, models, influencers, and other talent who work with or through SocialCreators do so as independent contractors, not as employees. SocialCreators acts solely as a matchmaking intermediary between brands and talent. No engagement with SocialCreators, whether as a creator, brand representative, or any other capacity, creates an employment relationship with SocialCreators.

1. Independent Contractor Status (Creators)

By submitting an application, accepting a campaign, or receiving payment through SocialCreators, you acknowledge and agree that:

SocialCreators does not withhold taxes on your behalf, does not issue tax documents (such as 1099 forms in the US), and is not responsible for any tax liability you may incur from payments received through campaigns. It is your responsibility to consult with a tax professional in your jurisdiction.

1.3 Control and Independence

As an independent contractor, you retain control over how you perform your work, subject to the agreed creative brief. You are free to work with other brands, agencies, and platforms at any time. SocialCreators does not impose exclusivity unless explicitly agreed in writing for a specific campaign.

SocialCreators acts as an intermediary. We:

Campaign rates are agreed between SocialCreators and the creator prior to the start of production. SocialCreators coordinates payment on behalf of the brand once final content is approved. Payment timelines are outlined in the individual campaign brief. SocialCreators may deduct a service fee from the total campaign budget before disbursing creator payments. The specific fee is communicated at the time of campaign offer.

SocialCreators is not liable for brand non-payment beyond commercially reasonable collection efforts. In the event a brand fails to pay after content has been delivered and approved, SocialCreators will make reasonable efforts to collect on the creator's behalf.

7. Governing Law

These Terms are governed by the laws of the Republic of Colombia. Any disputes that cannot be resolved informally will be submitted to the competent courts in Medellín, Colombia. Parties agree to attempt good-faith resolution before pursuing formal legal action.

8. Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of our services after changes constitutes acceptance. We will communicate material changes by email when we have your contact information on file.
